SMS Terms & Terms of Service

These terms apply to the Grouptextly group text messaging program and to use of grouptextly.com and the Grouptextly service, operated by grouptextly.com (“Grouptextly,” “we,” “us”). Part A is for people who receive text messages. Part B is for organizations and individuals who use Grouptextly to send them.

Part A: SMS terms for message recipients

1. Program description

Grouptextly lets families, community organizations and clubs send text messages to their groups. If you opted in, you receive group messages from that organization, club or family (for example schedules, reminders, updates and announcements), sent through Grouptextly from a dedicated phone number assigned to the group. You can reply to messages. Messages are sent by the organization, not by Grouptextly itself.

2. How you opt in

You receive messages only if you agreed to receive them from the organization that added you, for example by checking the consent box on your group's join page, or through another method where you give your consent directly, such as in person or by texting a keyword to the group's number. The organization is responsible for collecting and keeping your consent. Consent to receive messages is not a condition of any purchase. Submitting the application form on grouptextly.com is a request to use our service and is not an opt-in to receive text messages.

3. Message frequency, costs

Message frequency varies depending on how often your group sends messages. Message and data rates may apply, according to your mobile plan. Grouptextly does not charge recipients.

4. Opt out: STOP

Reply STOP at any time to stop receiving messages from that group. You may also use STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT. You will receive one confirmation message saying you have been unsubscribed, and no further messages from that group will be sent unless you opt in again. If you are in several groups, each group number is opted out separately. You can also ask us to stop all messages sent through Grouptextly to your number on our unsubscribe page.

5. Help: HELP

Reply HELP to any message for help, or email contact@grouptextly.com.

6. Carriers and delivery

Supported carriers include major U.S. carriers, though coverage can vary and may not include all carriers. Carriers and Grouptextly are not liable for delayed or undelivered messages. Delivery is not guaranteed.

7. Privacy

Your information is handled as described in our Privacy Policy. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.

Part B: Terms of Service for admins

8. Eligibility and accounts

You must be at least 18 and able to enter a binding agreement. Accounts are opened by application and we may approve or decline any request. Keep your login details secure; you are responsible for activity under your account and for the accuracy of what you give us.

9. Your responsibilities as an admin

• Only text people who have given you prior express consent to receive messages from your group, and keep records of that consent (who, when, and how).
• Comply with all applicable laws and industry rules, including the Telephone Consumer Protection Act (TCPA), carrier requirements, and the CTIA Messaging Principles and Best Practices.
• Honor STOP and other opt-out requests immediately, and never re-add someone who has opted out without their new consent.
• Respect quiet hours: do not send messages in the early morning or late at night in the recipient's time zone (we recommend no texts before 8 a.m. or after 9 p.m.).
• Identify your group in your messages, and make sure messages match what recipients agreed to receive.
• For minors, obtain consent from a parent or guardian.
• Do not use purchased, rented, scraped or shared lists.

10. Acceptable use

You may not use Grouptextly to send or facilitate:

• spam or unsolicited bulk messages, or messages to people who have not consented;
• content related to sex or adult material, hate speech, illegal or unregulated alcohol, firearms, tobacco or vaping, or illegal drugs, or other content prohibited by law or carrier rules;
• phishing, scams, fraud, deceptive or misleading messages, or impersonation;
• harassment, threats, or content that is unlawful or infringes others' rights;
• attempts to evade carrier filtering (such as spreading identical messages across numbers) or to disrupt or probe the service.

We may filter, block, suspend or remove messages, groups or accounts that we believe violate these terms, with or without notice.

11. Plans, billing, cancellation

Grouptextly is offered on monthly plans priced by the number of members (currently $19, $49 and $99 per month; see the pricing section for current details). Plans are billed monthly in advance through our payment processor and renew automatically until cancelled. You can cancel anytime; your cancellation takes effect at the end of the current billing period, and fees already paid are generally not refunded except where required by law. We may change prices with advance notice.

12. Your content and data

You keep ownership of your contact lists and messages. You give us permission to process them to provide the service, as described in the Privacy Policy. You confirm that you have the right to do so.

13. Disclaimer

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted or error-free, or that messages will be delivered or delivered on time. Do not rely on Grouptextly for emergency or life-safety communications.

14. Limitation of liability

To the fullest extent permitted by law, Grouptextly will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, and our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim arose. You agree to indemnify us against claims arising from your messages, your lack of required consent, or your violation of these terms or the law.

15. Termination

You may stop using Grouptextly at any time. We may suspend or terminate access at any time, including for violations of these terms or legal or carrier requirements. Sections that by nature should survive termination will survive.

16. Changes

We may update these terms from time to time. The “Last updated” date shows the latest version, and continued use after changes means you accept them. We will make reasonable efforts to notify account holders of material changes.

17. Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
